The Manual IP, often referred to as the Brown Book, is an extensive guide that provides detailed information on patents, utility models, trademarks, and designs across 240 different regions worldwide. Keeping this information current is a significant effort for us as the publisher, as well as for the numerous local experts who annually review and update each section to ensure the most recent data is included. Every year, we highlight three companies for their outstanding collaboration, which greatly contributes to the success of the Manual IP.
To start with, Ana de Sampaio and Nuno Gouveia from J.E. Dias Costa oversee several nations within Africa and the Portuguese segment. Next, Xia Zheng from AFD China manages one of the more complex regions, where frequent updates can lead to significant changes. Lastly, a new addition to the Manual IP family is the IP team from Jah & Co, led by Jehad Ali Hasan. They have provided an entirely new section on Aden in addition to revising three other sections.
We spoke with the authors regarding their areas of expertise and their contributions to the Manual IP.
Not just advantageous for those reading it
Every chapter in the Manual IP follows a uniform structure, thanks to the standardized table of contents. According to Xia, "The Manual IP is systematically organized, with clearly arranged topics that facilitate easy access to information. Furthermore, it offers thorough and succinct details, making it an important reference tool."
The framework is only a minor element of the Manual IP; the real value lies in its content. The authors concur that this is advantageous not only for the readers. “Contributing to this publication enriches our information-centric methodology and provides us with a chance to meticulously evaluate all practices,” Jehad remarks. Nuno adds, “It also helps us stay informed about legal and regulatory updates across different regions, which is crucial for delivering precise and pertinent information to our audience.”
Nuno goes on to say, “Contributing to a publication like the Manual IP is a demanding task, given that we have the chance to add to a highly esteemed and extensively utilized resource in the realm of Intellectual Property.”
Ever-evolving environment
Out of the 240 jurisdictions, a handful always demands extra focus each year. These regions introduce new legislation, modify existing regulations, and make other significant changes. Reflecting on a past update, Xia recalls, “In 2020, when the Chinese Patent Law was revised, it involved numerous changes. We had to thoroughly examine the Chapter to ensure all updates were accurately reflected. Although it was time-consuming, we believed the effort was justified because we were contributing to something substantial that would help many readers.”
Apart from the significant revisions, there are usually additional updates required for the chapters. These could involve modifying fee structures, updating PPH details, or other specific information. There is always some activity or change happening in the realm of intellectual property, which is evident to all of our contributors.
Nuno stated that the main difficulty in updating chapters is staying current with the ever-changing landscape of intellectual property laws and regulations. These changes can occur often and be quite substantial, varying from small legislative tweaks to comprehensive overhauls.
Jehad mentioned that in the Middle East, intellectual property laws are continually being updated. The countries in this region are revising their regulations and practices to align with global standards.
Modifying the Manual IP
Local experts must input all relevant data for each jurisdiction. Nuno's firm handles numerous jurisdictions, which adds to the complexity. This diversity necessitates a thorough grasp of the legal nuances in each country, particularly in areas where it is challenging to determine if the changes are currently effective.
Navigating this within a single jurisdiction can be difficult, according to Xia. "One of the hurdles we encounter is bridging the time gaps between updates to the Patent Law and the subsequent revisions to its implementing regulations and patent examination guidelines. However, whenever we revise the China chapter, we'll ensure to include the most current information available and strive to keep our readers informed about the latest developments."
